Prevention means reading before you sign and writing down what happens if things go wrong. In a market built on foreign investment, hospitality and residential tourism, disputes rarely start in court: they start in a document drafted badly months earlier.

In practice, that is four things:

  • Reading the document you are about to sign and putting the risk in writing.
  • Investigating the counterparty and the asset before any money moves.
  • Drafting the contract so the bad scenario is already solved in the text.
  • Documenting the relationship while it is going well, which is when nobody wants to.

Three stages: prevent, settle, and litigate if there is no deal

The order is the argument. A firm that only litigates needs you to have the problem; this one would rather you never had it.

  • Prevention. Built so it does not break. It is the cheap part and it defines the firm.
  • Settlement and mediation. It broke: it gets solved at the table, in writing.
  • Court representation. No agreement: we litigate, with the file that should have been built from day one.

What does preventive law mean in practice?

It settles a legal matter on paper before it reaches a court: reviewing, investigating and drafting while the parties still agree. It costs less than the lawsuit it prevents and it does not depend on a third party ruling in your favour.
