Timeshare cancellation in Cancun works in some cases and not in others. If you signed less than 5 business days ago, Mexican consumer law gives you a window to rescind with no penalty.

Almost nobody reads this page by choice: you signed in a sales room, in a city that is not yours, after a long presentation, and read the contract calmly weeks later. Two things you may not have been told: not every case has a way out, and anyone promising otherwise before reading your contract is selling you something.

First: who you’re talking to

Around timeshares a second industry grew up, just as damaging as the first: companies that advertise themselves as “cancellation specialists,” charge an upfront fee, promise guaranteed results, and disappear. Many of their victims had already been victims once.

How to tell them apart, even if you don’t choose us:

  • A law firm doesn’t guarantee results. None can, and promising one is professional misconduct.
  • A law firm tells you no when the answer is no, even if that means not getting paid.
  • A law firm has an office address, a bar license number, and one identifiable person who signs. You can verify it before you write to us.
  • No one legitimate will ask you to pay to “release” a supposedly authorized refund. That story is always false.

The paths that actually exist

It depends on three things: when you signed, what the contract says, and what you were told in the sales room.

If you signed a few days ago, Mexican consumer-protection law grants a withdrawal period to cancel the deal with no liability. It’s short, counted in business days, and cannot be extended. If you’re still inside it, don’t read the rest of this page — write to us today.

If that period has passed, the real paths are others:

  • A complaint before the consumer-protection authority. Timeshares are regulated under an official standard: disclosure obligations, a registered contract, prohibited clauses. A contract that fails to comply is a contract that can be challenged.
  • Nullity for defects of consent, when what was promised in the sales room isn’t what the contract says: availability that doesn’t exist, fees that rise without limit, an “investment” that never was one.
  • Direct negotiation with the operator, which in many cases prefers a documented exit over a formal proceeding.

What is a «cancellation company» and why be careful?

Companies that advertise as cancellation specialists, charge a large retainer, promise a result before reading the contract, and disappear. A real firm tells you first whether you have a case, and does not charge for a promise.

Which documents do I need?

The contract with every annex, proof of payments, the marketing or presentation you were shown, and any email or message with the salesperson. With those 4 things the case can actually be assessed.

Should I stop paying while it is resolved?

Not without analysis. Stopping payments can strengthen or ruin your position depending on the route and the contract. It is exactly the decision to take with the contract read.
